April 30, 2013: Discovery Park Tentative Plan, Public Meeting Notice


PUBLIC MEETING NOTICE

DATE: May 20, 2013

TIME: Open House drop-in between 5:30 PM and 7 PM

LOCATION: Discovery Park Lodge, Brooks Meeting Room, 2868 NW Crossing Drive, Bend

PROPOSAL:
The proposal involves the Tentative Plan for the subdivision of the Discovery Park quadrant in the following phases: Phase 24 (29 lots), Phase 25 (25 lots), Phase 26 (19 lots), Phase 27 (8 lots), Phase 28 (35 lots), Phase 29 (20 lots) and Phase 30 (39 lots). The expected timeframe for initial development will be 2014 through 2017. In addition, information will be provided about the future development of Discovery Park. Though, Discovery Park will not be part of this Tentative Plan, it will be submitted for city of Bend approval through a separate Site Plan application later this year.


LOCATION: The areas subject to this application are within the Discovery Park Quadrant in the northeast section of Northwest Crossing, identified as Tax Lot 300 on the Deschutes County Assessor’s Map 17-11-36. The proposal is located within the Northwest Crossing Overlay Zone that is located generally south of Shevlin Park Road, north of Northwest Crossing Drive bordered by the Urban Growth Boundary on the west and Mt. Washington Drive on the east.

April 29, 2013: Panterra Public Meeting Notice

NOTICE OF PUBLIC OPEN HOUSE


An informal meeting regarding a proposed self-storage facility to be located in NW Crossing District 2, Lots 10, 11, & 12, a.k.a. 2825 NW Lolo Drive. This is east of and adjacent to the Ruff Wear (former Breedlove Guitar) building. The proposal includes a mix of RV storage and storage rooms within an enclosed area. The access will be from Lolo Drive. Operationally, access will be limited to certain hours; lighting, with the exception of motion detecting lights, will go dark commensurate with gate hours; no truck or trailer rental franchise is being considered; there will be employees on site but there shall be no on-site living facility.

Development Code and the General Plan applicability:
The applicable criteria for approval is the determination by the governing authority (City) that the proposed site plan (height, setbacks, etc.) meets established criteria and that the development is not in conflict with the General Plan (land use/zoning). The proposed site plan conforms to the requisite City criteria. A self storage use is permitted in this zone by code.


Approval Process
Type II decisions are made by the Community Development Director following public notice and an opportunity for parties to comment but without a public hearing unless the Community Development Director elevates the application to the Hearings Body for hearing as a Type III.

Required Statements:
Any person may comment in writing and include a general explanation of the requirements for submission of testimony and the procedures for conduct of testimony, including, but not limited to, a party’s right to request a continuance or to have the record held open.
If a hearing is to be held, any interested person may appear and provide evidence.


Failure to raise an issue in person or at a hearing or in writing precludes appeal by the person to the Land Use Board of Appeals (LUBA), and that failure to provide statements or evidence sufficient to afford the decision-maker an opportunity to respond to the issue precludes appeal to LUBA on that issue.


A copy of the application, all documents and evidence submitted by or on behalf of the applicant and applicable criteria are available for inspection at no cost and will be provided at reasonable cost.


A copy of the staff report will be available for inspection at no cost at least seven days prior the hearing and will be provided at a reasonable cost.
 

April 4, 2013:  Update on Zone Change/Text Amendment

The first reading of the NorthWest Crossing Overlay Zone text amendment and zone change was unanimously approved by the Bend City Council on Wednesday evening, April 3rd.  West Bend Property Company met with a group of residents earlier in the week and agreed to amend the application by changing 9 permitted uses under the Mixed Employment zone to 8 Conditional use and 1 Not Permitted use (Mini-storage).  These use restrictions only apply to lots fronting Mt. Washington Drive south of NW Clearwater Drive in NorthWest Crossing: District 1, lot 17; District 2, lot 2 and District 2, lot 3.   The second reading for this application is scheduled for 4/17/13; then the zone change and text amendments will be codified on 5/17/13.  NorthWest Crossing resident Chris Atkin was present at the City Council meeting and spoke in favor of the revisions and the collaborative process with West Bend Property Company. 

 

March 27, 2013: Panterra Development lot purchase terminated

West Bend Property Company and Panterra Development terminated the purchase and sale agreement for Lot 2 in District 2 of NorthWest Crossing on March 27th.  The proposed storage facility will not be built on lot 2, or any lot, along Mt. Washington Drive. 
 

March 22: Update on Proposed Storage Unit Facility

Date:   March 22, 2013

To:       NorthWest Crossing Residents/Owners

We met with Jeff Payne of Panterra Development this morning and we are pleased to advise you that Panterra will not proceed with the purchase of Lot 2 in District 2 of NorthWest Crossing and will not be building storage units on that site.  Mr. Payne is carefully considering our offer for him to purchase Lots 10, 11 and 12 in District 2 to construct storage units.  We have advised Jeff that West Bend Property Company will be fully supportive of his efforts on these lots.

If Panterra does elect to proceed with Lots 10, 11 and 12, there will, of course, be another public information meeting with notice to nearby residents before a site plan application is filed with the City.  Any construction will require design approval of the NorthWest Crossing Architectural Review Committee.

We believe Mr. Payne’s decision was strongly influenced by his desire to become an accepted and respected owner and business operator in NorthWest Crossing.  We hope you will join us in supporting him and his business.

March 15, 2013: Letters to Residents/Owners from WBPC Board Regarding Storage Unit Facility

To:       NorthWest Crossing Residents/Owners

Many of you are aware of the proposed construction of a self-storage facility by Panterra Development on Lot 2 of District 2 in NorthWest Crossing. Panterra Development has a legally binding purchase and sale agreement to purchase Lot 2 from West Bend Property Company, and the proposed use on Lot 2 is permitted under the Industrial Employment Zone in place since 2001.  As the buyer and developer of Lot 2, Panterra Development is responsible for all notifications and conducting the public meeting, which we understand is scheduled for 4pm Monday, March 18, now at the Summit High School library.

For many years we have been encouraged by residents to consider building storage units as an additional amenity in our mixed-use community. We admit we were surprised by the negative reaction from some of our owners to the proposed location of the storage units on Mt. Washington Drive.

After hearing from and meeting with many of you, we met with Mr. Jeff Payne, President of Panterra to seek a compromise.  We offered to sell Panterra Development Lots 10, 11 and 12 in District 2 (located by the former Breedlove and now Ruffwear building along Skyliners Road) in place of Lot 2 to develop the storage units.  We offered these alternative lots at a discount to encourage him to reconsider.  Mr. Payne at this time declined our offer and believes residents will support his facility and location after his informational meeting.  Mr. Payne did suggest that he may reconsider our offer to move his sales agreement contract from Lot 2 to Lots 10, 11 and 12 after the public information meeting.                                                                                            

We deeply appreciate the concern, care and passionate feelings many of you have for NorthWest Crossing.  Thank you for helping us make it an even more desirable neighborhood.

March 4, 2013: Panterra Development Public Meeting

West Bend Property Company has accepted an offer from Panterra Development for the purchase of Lot Two, in District Two of NorthWest Crossing for the development of a storage facility.  This lot is located on the west side of Mt. Washington Drive, in an area that allows this type of facility.  Examples of other uses acceptable in this zone are light manufacturing, printing and book publishing, auto and truck repair/service and sales, bakery, beverage bottling plant, commercial laundry, warehouse and distribution center, just to name a few.

The buyer is in the due diligence period and has been very proactive and open by sending residents within 500 feet of the property a notice to come to a public hearing on March 18 at 4:00 pm at 2755 NW Crossing Drive, Suite G-205, above Pisano's Pizza.  We invite any resident of NorthWest Crossing to attend if you would like to learn more about the proposed use on this land. 

Over the last decade, West Bend Property Company has received numerous requests for this type of use in the neighborhood, and has accepted this offer based on the demand and belief that this addition is an amenity to the neighborhood.  Due to the design of NorthWest Crossing with alleys and smaller, denser lots, many residents find the need for additional storage for recreational toys, vehicles, or simply household items. As you know, there are design guidelines and standards for both residential and commercial/industrial uses in NorthWest Crossing.  This project will be subject to the same standards and expectations as any other project that has been built to date.  NorthWest Crossing is an award winning community due to its attention to detail, mix of uses, and design of streets and buildings.  We intend to continue to strive for this level of excellence.

December 2012: Zone Change/Text Amendment

West Bend Property Company, the developers of NorthWest Crossing, recently submitted a Zone Change/Text Amendment application to The City of Bend. The documents included in that application are below.
